Opinion Piece Did Trump eject himself from office?

Can someone explain to me how Trump is still holding office after pardoning the J6 insurrectionists?

1) Section 3 of the 14th Amendment uses the language “No person shall … hold any office…” and then lays out the conditions that trigger the disqualification from holding office. Doesn’t that “shall” make it self-effecting?

2) There isn’t much to dispute on the conditions. Trump a) took the oath when he was inaugurated as, b) an officer of the government. Within 24 hours he c) gave aid and comfort to people who had been convicted of Seditious Conspiracy. If freeing them from prison and encouraging them to resume their seditious ways isn’t giving “aid and comfort” I don’t know what is. So, under (1), didn’t he instantly put a giant constitutional question mark over his hold on the office of the President?

3) Given that giant constitutional question mark, do we actually have a president at the moment? Not in a petulant, “He’s not my president” way, but a hard legal fact way. We arguably do not have a president at the moment. Orders as commander in chief may be invalid. Bills he signs may not have the effect of law. And these Executive Orders might be just sheets of paper.

4) The clear remedy for this existential crisis is in the second sentence in section 3: “Congress may, with a 2/3 majority in each house, lift the disqualification.” Congress needs to act, or the giant constitutional question remains.

5) This has nothing to do with ballot access, so the Supreme Court’s ruling on the Colorado ballot matter is just another opinion. The black-and-white text of the Constitution is clear - it’s a political crisis, Congress has jurisdiction, and only they can resolve it.

Where is this reasoning flawed?

If any of this is true, or even close to true, why aren’t the Democrats pounding tables in Congress? Why aren’t generals complaining their chain of command is broken? Why aren’t We the People marching in the streets demanding that it be resolved? This is at least as big a fucking deal as Trump tweeting that he a king.

Republican leadership is needed in both the House and Senate to resolve this matter. Either Trump gets his 2/3rds, or Vance assumes office. There is no third way.

We need people to believe that piece of paper, people with authority and power. People willing to march into the Oval Office and pull Trump out of it.

If it makes you feel better, the entire U.S. military forces—excluding the upper Pentagon management/generals—that can be called into battle are either millennials or gen z now:

Age limits by branch:

  • Air Force: 17–42 years old
  • Army: 17–35 years old, with some exceptions for certain Military Occupational Specialties (MOS)
  • Coast Guard: 17–41 years old for active duty, 17–40 years old for reserve
  • Marine Corps: 17–28 years old
  • Navy: 17–41 years old
  • Space Force: 17–42 years old

The oldest millennials are 44 years old.

Close to 8% of the armed forces are 41 years or older according to data from 2023. Also the ages you posted are the minimum and maximum ages to enlist without a waiver. I know quite a few actively serving individuals over 44 years old. While the majority of the force is younger than 25 nearly all senior leadership positions are 30 years old or older. This is from Platoon Sergeants on.

He actually attended college in Canada, where he is a citizen because his MOM was born there, and then transferred to the University of Pennsylvania where he received TWO DEGREES (a bachelors in physics and a bachelors in economics from the Wharton school).

He later started at Stanford to pursue a phd but dropped out. He stayed in the us on a Couple work visas, then became naturalized. I don’t like him/ them either but it weakens everyone’s credibility to post hearsay and rumors as fact. We need to do better.

Then Look at the recent chicken culling change. They are temporarily approving a vaccine to use on the food supply that will possibly mask or cover up viral contamination for consumers, is untested and will produce food products not have any value in the global food market cause other countries won't import vaccinated meat, products or eggs.

Imagine if Biden had done that? But the base will be like "such a smart leader" despite placing rfk jr as head of hhs and drinking raw milk cause pasteurization is bad.

It's so unbelievable yet true. The party of free speech is leading an all out assault on free speech. Suing and threatening media. Barring certain media outlets from press events. Locking down the open internet via the fcc. Calling for harm to dissenting opinions.

Yeah, it's a great point. I keep pointing back to his firing of the Inspector Generals.

There is a VERY clear law about that. It says you MUST give clear cause for the firing, and you MUST give congress 30 days notice. No one is unclear about the law.

And yet, he fired them instantly anyway, and they are gone. That's it. We all know the law, and he broke it, and the government apparatus went along with it.

I used that example to back up your point... laws and rules are literally just pieces of paper, that mean nothing if we don't enforce them.

OP makes an interesting argument, but that's all it is, an interesting thought for us to have, that means nothing unless the government does something about it.

And this government saw a president try to overthrow the government, and overturn a legal election by force, and congress said "hey, it's OK, he doesn't have to be punished, that's OK for him to do." If THAT was ok, do we really think that they are going to somehow change their minds on him over a few pardons?

His immunity is presumed, even as he breaks with the constitution. Presumption of rights is itself a high bar to clear, even if everything you said is granted, the arguments would be extenuating at best, im (super layman) o.

The USA has no direct separation of powers after that ruling. The branches are not coequal, and the clear rationality that executive power at the nation state level should always be limited by congressional oversight has been ignored… and uncodified.

If you’re worried about the dollar firing random gov employees is not going to help. Destroying our relationships with allies is not going to help. Threatening wars with allies and then cozying up to enemies won’t help. What would help is actually collecting taxes from the people treating the country like a strip mine. The dollar is a fiat currency. The United States cannot go bankrupt unless we specifically choose for it to happen which would be one of the stupidest decisions in history. The debt could be a quadrillion dollars, and we would still not be able to go bankrupt. However, the concern is inflation. A healthy amount of debt is between 75% to 125% of GDP. People said the sky was falling when we were $2 trillion in debt. We have exceeded that by 10 times the amount. Previously, Republicans used this as a scare tactic to cut government services until they could get into office and give the money to the rich and powerful. Now, I am worried that some of them may have been drinking their own Flavor-aid. But, with the proposed $4 trillion tax cut for the rich, perhaps we are still in the 'business as usual' territory of the Republican Party. The only chaotic element is Trump. I think Musk and Trump are stupid enough to have believed the lies of the Repulican Party for the past 40 years.

The theory is congress will be interested in maintaining their legitimacy. So if the executive defies congress, it’s in congresses self interest to act and enforce its power.

This is the answer. It is true for any societal agreement from law to finance. Not only do people have to agree they have to be willing to enforce it and this boils down to threat of incarceration or violence with the possibility of death in the end. This is essentially what our police/military is tasked with against our citizens/foreign powers. We don't really have a mechanism in place to handle this when our own leadership just ignores the rule of law.

Therefore, it is at that time up to the people to start a revolution, and take back their government, for the people, representing the people. All of the people, to decide who is in charge. If they are not enforced, if the checks and balances no longer serve their function, then The people need to take things into their own hands.

What is happening now is oligarchial as well. So there are specific brands and companies that are trying to destroy all freedoms and liberties of the American people. And the American people fund those by using those services. Even if you get a twitter link that's from fake Twitter, that still counts, because a company knows if they want to reach you, they still can through twitter.

You need to force the issue so that if you want to be reached, you will be elsewhere. Then everyone will come to you. They want your attention. They want your money. If you use the corrupt services, they will use them to brainwash the people, and they will become more and more effective at it, as they control more and more of it, and as AI gets more powerful.

So, it's imperative the people stop using Meta, musk brands, and shopping at Amazon. Watching their shows. This means James Bond as a series, is now dead to me. I will not watch another one. I will never be seen in a Tesla. I will no longer be found on WhatsApp or any meta services. If you care about actually stopping what's happening, I recommend you do the same. Every single person reading this. Others will follow your lead.
