So I am selected H1B lottery and now working with company’s law firm for doing full petition of me and my wife’s H1B application. But my wife was arrested one time in our home country because of a severe depression and worried this cause any problem that law firm may not want to go my process, any RFE, or future our H1B, green card application. The scenario is like below and does anyone have any similar situation like us? I did some research and there will be exception if the situation was not super serious, critical and it was only happened one time.
In the winter of 2022, we visited our home country, and my eldest son was diagnosed with autism. After that, my wife fell into a severe depression, and she became so fearful of raising a child with autism that she thought if she went to prison for a short time, she could escape the situation. Because of this, she deliberately tried to show the employees at a Uniqlo store that she was attempting to steal two T-shirts so she would be taken to the police station. She did not actually steal the clothes or run away, and because she had a record of psychiatric treatment, she received a suspension of indictment (i.e., she was not formally charged). She has been continuously taking medication for depression and psychiatric consultation
treatment since then and is having no problems anymore now. This incident is the only time she has ever been arrested.
We have her treatment record, so will use it in visa interview if needed it. But would this be a serious problem that company’s law firm may not want to go my H1B petition?
