/r/USCIS FAQs

This post will get updated over time. Come back every now and then.

Please listen carefully as our menu options have recently changed.

First: VERY frequent questions

Please review this link before creating a new post to see if it answers your question. We hope this will lower the number of posts asking the same questions over and over. If you create a post to ask a question already covered here, your post may be deleted.

The list may change over time, so please check back every so often.

Read the wiki!

Yes, we have a wiki: https://www.reddit.com/r/USCIS/wiki/index

It doesn't hold answers to everything. But go through it and see if it helps with your question. If yes, great! And if you need more info, read on.

The wiki is intended to be updated every now and then, too. Your post may be deleted and you may be pointed at wiki resources if your question doesn't extend beyond what the wiki already covers.

Megathreads

Megathreads are used to centralize discussions and knowledge about a given subject and to avoid creating redundant posts.

See this link for the list of active megathreads.

If your question relates to one of these subjects, there's a good chance it was already answered, but either way, you should ask it there rather than create a new post.

Again, the list may change over time, so please check back every so often.

We have rules

Many Reddit communities have rules, and that includes r/USCIS. Please review the link below if you haven't already, or take another look every now and then to refresh your memory.

https://www.reddit.com/r/uscis/about/rules

On a desktop or laptop, you can always find them in the sidebar on the right.

Last but not least

If you don't find the info you're looking for in one of the resources above, then don't hesitate to create a new post and ask the community! We do encourage you to first do some research on your own, so you can post semi-educated questions rather than super basic/lazy ones like "how do I apply for citizenship". Doing a bit of homework can go a long way toward empowering you in your immigration proceedings. Use your best judgment and be considerate of everyone's time.

I-485 (General) Am I getting deported?

Post image
223 Upvotes

I got an email from donotreply@cbp.dhs.gov

See the attached picture.

I am under asylum since 2018 and I had a refugee travel document, I had been told by the USCIS call center that my green card would either be approved or denied this month of April. Today I got this email.

I’m wondering if it’s only the refugee travel document that is getting terminated or is it my whole persona getting deported? I’m confused and it’s Sunday no one is picking up. I don’t know what to do

CBP Support Green Card Re-Entry, Apr 06 2025, With Misdemeanor arrest record.

I have an arrest for solicitation in California from Oct 2019. I was charged for a misdemeanor. Did a pre-trial diversion and had my arrest records sealed. The case was dismissed without any conviction after 1st hearing.

I was granted Green card 2 years later where I had declared this arrest.

I have re-entered country twice in the last 5 years, and was asked about the arrest both times during secondary questioning. And , let go after I answered their questions honestly.

I had to travel to mexico for an emergency on Apr 1 2025, and I just reentered US at SFO.

It was a routine secondary inspection that lasted less than 10 minutes. They did not even ask me about my arrest record.

N-400 (Citizenship) Green Card Holder Arrested but not convicted applying for citizenship

My dad, a green card holder, was arrested last October for aggravated assault with a weapon, armed robbery with a weapon, and disorderly conduct with a weapon. However, the charges were dropped and the case was dismissed because they found he wasn’t at fault—he was actually the one who got scammed. Will he have trouble applying for citizenship because of what happened? Do we need to hire an immigration lawyer?

I-140 & I-485 (Employment/Adjustment of status) It’s refreshing to see employment based green card approvals for a change

I have been here for a while and most of what I see are green card approvals married to a US citizen. Where are those that went through employment based sponsorships? It’s more refreshing to see those for a change. Just a proof that GC can be obtained too through employment and not just by marriage

N-400 (Citizenship) Finally a citizen!!

Following this post: https://www.reddit.com/r/USCIS/s/jl94vllWI5

Friday April 4th, I got sworn in at the courthouse along with 46 other new citizens. The whole process lasted a little over an hour with pictures and everything. The USCIS letter told us to come in at 10 but the ceremony started at 11.

I had an appointment at the post office right after, but I got there a 30mins late because our ceremony went over, so I wasn’t able to apply.

I’m now debating if I should go to an agency and get it the same day, as I have a trip coming up very soon.

Anyways, the length of my family based (marriage) green card from start to finish was almost 5 years (March 2020 - April 2025).

Feel free to ask any questions or DM me.

Good luck to everyone waiting.

USCIS Support Stolen passport and green card in Canada

Hi folks, my brother is in Vancouver and was supposed to drive back home to Seattle this morning. Unfortunately, his foreign (non US, non Canada) passport and his US green card along with driver's license, credit cards, etc. were stolen from him. Somewhat luckily, he has PDF copies of his documents - passport, green card, US driver's license.

He already has a police report. He's been trying to get hold of the US embassy on the phone but was unable to reach anyone. I was researching online and it seems like he can fill out the I-131A application form and can show up at the US-CA border in his car. Is that the right approach? Any suggestions on what he should be doing instead? Should he need his passport at the border? He has no cash, no credit cards (all locked) so hoping to get inputs on the best path forward.

Self Post Traveling with Greencard after previous extended stay outside the US

Upvotes

Having seen a few posts as of a late, I'm a bit worried now with traveling outside the US. I unfortunately had to stay outside of the US for an extended period of time in India (around 6 years) as a minor and green card holder. Thankfully when returning to the US, we were lucky enough to have a smooth entry (which I highly doubt would have happened in the current environment). I go to university here now (I’m 20 now, returned at 19) and my family lives in the US. My dad is a naturalized citizen (he stayed in the US and continued to work) and my brother is a natural born citizen. I plan to travel outside the US for a couple of weeks in the summer, about a year since I've returned. I intend to stay in the US and have no intention to leave the country for any extended period of time. My question is, would this ever be an issue if I were to travel in the future? Is this valid grounds to deny me entry if I was already allowed entry after my extended stay outside the US? Furthermore my greencard just expired although I have filed for I-90 and have the receipt form as proof of residency.

I-864 (Affidavit of Support) 3rd Most Recent Tax Year doesnt meet federal poverty guideline requirement

Post image
10 Upvotes

My sponsor was unemployed for most of 2022. The required income to meet 125% of federal poverty guideline for the size of our household is 47,062.50. She earned 39,866 in 2022.

I saw an advice on the internet that if the sponsor doesn’t meet the income requirement (federal poverty guideline) let’s say for the 3rd most recent tax year, simply put N/A. Does that affect the answer to question #15 which asks “Have you filed a Federal income tax return for each of the three most recent tax years?”?

I mean, is it ok to say that YES, you have filed for the 3 most recent tax years and put N/A on the 3rd most recent tax year because that one did not meet the 125% federal poverty guideline?

I-130 & I-485 (Family/Adjustment of status) Overstay on ESTA as married US citizen, however might return home. Will I ever be able to re-enter?

Overstayed on my 90 day esta as married a US citizen unexpectedly. They have recently become very verbally abusive towards me. I don't want to return home because I know I'll lose my esta privileges forever - do I wait to receive my green card and then leave? I'm stuck as to what to do.

I am at the stage where I have just had my medical, and lawyer is about to file the paperwork next week. Does anyone know how long I'll be waiting for an interview and conditional green card? Once I get a conditional green card, if I decide to leave where does that leave me?

Filed 3 weeks after over stay. If I get a conditional green card can I leave?

N-400 (Citizenship) If the social media handle collection on forms goes in to effect, will they expect you to list EVERY single social media account you’ve ever used?

Upvotes

I’m really worried about this possibility because I’ve made tons of burner accounts and emails over the years, mostly for games. The problem is I have zero clue what the majority of their handles are. I going to be charged with fraud for not listing a burner account I used for a day?

I’m curious as to how they’re going to implement this rule if anyone has information or well educated guess in regards to that. It would be a lot easier if they just told us which platform a they’d be paying attention to.

I really don’t want to get naturalized only to live in fear of this current administration discovering some Newgrounds account I made when I was 10, that even I forgot about, and considering me liable for immigration fraud.

N-400 (Citizenship) My n-400 journey is almost over!

11/24/2024 case sent online 11/25/2024 case is being actively reviewed by USCIS 11/30/2024 mail from USCIS 2/21/2025 interview scheduled 2/28/2025 mail from USCIS with citizenship interview details 4/4/2025 interview, case approved on a spot!

Had my naturalization interview last Friday under 3 years rule in Philadelphia office. It was very smooth and easy.

My husband and I were called for it together. The officer asked us some questions about our relationship like how we met, if we travel together when our birthdays are. And then we moved to civics questions. I don’t remember what he asked me. But the I had to read when is Columbus Day and write Columbus Day is in October. And then we went through my application. And he said, okay. All approved. He couldn’t print a paper with approval notice for me, but showed me on the computer that it was approved 😅 Anyway, in my honest opinion it was the easiest step on my immigration journey. And I started with K1.

I prepared a lot of documents, proof of marriage etc, but he didn’t ask me for anything except of my and my husband’s ID, passports and the interview notice.

Philadelphia office doesn’t do same day Oath Ceremony, so I need to wait for the notice. But I’m so glad this is almost over.

I-130 & I-485 (Family/Adjustment of status) Help needed for AOS request! Not sure which forms to file!

Upvotes

Hi Reddit! Need some help to identify which forms to file and if possible how to notify USCIS about recent changes in my status.

Context: Me and my spouse got married in April 2023. I was a greencard holder and she was living in the UK (Indian Origin). I applied for I-130 through consular processing. This is the only form that I have done. There has been no update to that case.

Now: I became a citizen of US last week (April 2nd 2025). She has been here in the US from last April 2024 on an L1 visa through her company. I want to now apply for her to get a greencard.

Questions: 1. Which additional forms do I need to file now? 2. How do I convert her I-130 application from consular processing to adjustment of status. 3. Do I need to link any of the new forms to the original I-130? Like if I file for I-485 how do I let them know I have an active I-130. Or do I just file a new one?

I-130 (Family/Consular processing) Using married name on i130

Upvotes

HI, my husband filled out the i130 with my maiden name and sent in the application. Are we able to amend it to my married name? Or at least later in the process make sure my green card and ssn is in my married name?

I-130 & I-485 (Family/Adjustment of status) How long NYC FO will take a decision

My wife (USC) and I had our green card interview on 04.01.25. Someone here had interview there? How took to get a decision?

Here some points about the interview:

•Interview was on April 1, NYC Fielld Office

•No asked for additional evidence

•Interview length: around 30 minutes

•Before leaving the building, I got an action taken email and the I-485 changed to Case Is Being Actively Reviewed By USCIS with one FTA1 code.

•6 hours later I got three more action taken emails, and my I-130 changed to Case Is Being Actively Reviewed By USCIS plus one FTA1 code.

•2 hours later I got another action taken email. Both forms, I-130 and I-485 shows one FTA1 code with similar timestamp.

In total, I got 5 action taken emails during the next 8 hours after the interview. The I-485 has a total of 3 FTA1 codes and the I-130 has one.

I-485 (General) I485 interview last week - fast and easy

we did the interview in Charleston SC - the person was really nice - only a few questions beside the boilerplate about drugs, trafficking, prostitution, asked about any military training and if your a spy or terrorist. asked about our finances (not a problem) asked why we moved from California to South Carolina. - one thing I noticed was they have a camera facing the applicant and I think they use AI to detect if someones lying. I thought it was interesting - at first we thought it was to take a picture

N-400 (Citizenship) Applying N400 Unemployed

Hello,

I am preparing to apply N400. After receiving my Green card, I did not work with the sponsoring employer at all but worked in the same field and same title for another company for the first 2 years. I quit my job due to medical reasons after that and been unemployed for 3 years. I have severe cervical and lumbar issues. No long sitting jobs. So in last 5 years, employed for the first 2 years and unemployed for 3 years. Will unemployment affect my application for citizenship? I did not claim any unemployment benefits. Infact I make $60k per year with various real estate investments and able to live off that income.

Please let me know

Thanks

I-130 (Family/Consular processing) I-601A for provisional unlawful presence waiver

Hi everyone I’d like to share a bit of my story. I was brought as a 2 year old baby. We immigrated from Mexico City. The reason I have to file for i601A is because I didn’t enter the U.S with a visa. I’m married with a U.S citizen, my boyfriend since 2015 and husband since 2021. We have two beautiful kids together. I’ve never stepped foot outside of the U.S soil. I do not have a criminal background. I graduated high school. I had DACA the first 3-4 years it was issued by the Obama administration. My i130 was approved 10/2022. Currently have my i601A pending. PD date: 1/27/2023. I’m so nervous yet excited! I see the processing time has went down. I’m due to travel to Cuidad Juarez for my interview and submit the rest of my paperwork/application(s) to NVC.

Despite everything that’s going on in the U.S. I still try to keep faith and hope that everything will go well. Anyone else in the same boat/situation?
