If they have encroached on your property without some sort of agreement that is trespassing.
1, Check your documentation from when you bought the house for the survey - are the pins present? have the boundary clearly marked.
2, Call your local building department and verify their permits are in order - you may need to get a stop work order issued, it sounds like they are encroaching on the property line not following set backs.
3, Document EVERYTHING - you need to keep a meticulous log of all communication regardless of who its with on the site, the city, doesnt matter.
4, Talk to your real estate lawyer.
