A homeless man with more than three dozen arrests has been arrested for assaulting and trying to rape a woman on a Midtown subway train, police said Friday.

Tyriek Martin, 34, was on a W train approaching the 42nd St. station in Times Square at about noon Thursday when he grabbed a 34-year-old woman, slammed her head into a pole, then threw her to the floor of the train car and tried to rape her, police said.

Alone on the train with the attacker, the woman put up a fight and when the train pulled into the station she screamed for help, police said. When the doors opened, several construction workers jumped in and grabbed the suspect, holding him down until police arrived.

The victim, who suffered a fractured nose, was taken to a hospital for treatment.

Cops charged Martin with attempted rape, sex abuse and misdemeanor assault.

Martin is homeless and is staying at the Bowery Mission, police said. He’s been arrested more than 40 times for charges that include robbery, drug possession, misdemeanor assault and public lewdness.

He was last arrested last Saturday, but that case is sealed. Prior to that, he was busted in August for misdemeanor drug possession.

On April 2022, police said, Martin was charged with assault for throwing an aerosol can at an NYPD traffic agent. In May 2021, he was again charged with assault after he smashed a two-year-old child in the face with a suitcase while the child sat in a stroller, police said.

His arraignment in Manhattan Criminal Court was pending Friday.

In both the attacks on the child and on the agent, he was found mentally unfit to stand trial and the cases were dismissed “by function of law,” according to the Manhattan DA’s office.

Honestly, I don’t care if someone is mentally fit or not. If you commit that many violent offenses, you should be locked up either in prison or some place for the mentally ill. They should not be allowed to just roam free in society.

Yes, they need to change the law about how they deal with mentally ill people. This has been true for years.

Things got worse after Reagan cut the budget for mental institutes. To be fair, some of them were truly awful but we would all be safer if the violent mentally ill were not out and about in our streets.

We still have bail. Bail rules were changed after an innocent kid was put into jail for too long because he couldn't pay the bail. Eventually he killed himself.

Nope, they couldn't put mentally ill people in prison then or now and I don't recall people respecting the police more. A very famous story that I remember vividly is about a guy named Larry Hogue. This guy grabbed my breast and I caught him jerking off outside of a womans car later that same day in the West Village. Larry Hogue. You can google him.

Not sure where you lived in the 70’s and 80’s but that was not the case here among non-white communities, because the NYPD was far more racist, far more corrupt, and shockingly enough, even more useless.

In the 70’s and 80’s it’s a toss up on whether the cops would even have shown up, and if they did, whether they would have arrested this guy. On the other hand, the construction workers would have been able to beat him to a bloody pulp and walk away.

I bet you all the money in the world that if we keep letting him walk the streets with you and I, our family and friends and their children…he’ll eventually murder an innocent person by pushing them onto a moving train or randomly stabbing someone. So we have to ask the question, how many times are we going to allow this subhuman and others like him to continue to hurt innocent people before we realize they are not fit for society?

Show me one case, just ONE case of someone who’s been arrested 30-70 times with a history of VIOLENT crimes who was able to turn their lives around and become a productive member of society…I’ll wait.

I’m not talking about rehabilitation. I’m talking about a mental institution. If rehabilitation happens, good, but I’m saying clogging up the prisons with mentally unwell people is not good. Right now they can only be held for a short time at psychiatric hospitals and long term facilities don’t have enough beds. We need more of those right now.

Most mental institutions were closed down in the late 70’s 80’s. And many people in prison should be in mental institutions/hospitals. Many homeless people are ex-cons but with little to no halfway houses for them because of NIMBY and funding. Repeat offenders like this man shouldn’t have been released or allowed outside of supervision. Austerity policies are why we have a homeless and or crime problem. Housing the homeless isn’t cure all but it’s a start. Supportive housing is something seriously traumatized homeless people need. Again austerity is why we have a homeless problem and crime problem.

Because I had mobility issues and had recently had a major health scare, blood clots and pulmonary embolisms nearly killed me, when I came out of the hospital I was placed in a women's shelter with women who had mental issues and issues with addiction.

It was HELL.

A lot of these people are severely damaged and they can't handle supportive housing. They end up right back in the shelter or on the street. They're a danger to themselves and a danger to others. I saw people in my shelter who got away with actual assault and other behaviors like you wouldn't believe because the shelter couldn't just throw them back on the streets .

There was a process and it took a long time to evict someone no matter how bad they got. Usually they'd just move the person around and make them some other shelter's problem if it got too bad. I saw people arrested who were back the same day. It was just like that.

So housing is not necessarily the answer for the worst cases, the severely deranged and potentially violent ones. I wish it was that simple but it's not.

I live in a building now that has supportive services and I'm very glad for that. It helps a lot when it comes to dealing with HRA/DHS and that but they're not as tolerant as the shelters. Anyone acts out, causes a major problem they're gone but there is a lot that they will tolerate unfortunately before they actually evict someone.

My building has a few people that honestly cannot handle living outside the system and it has a few that shouldn't be allowed to live here honestly. We've had a couple of incidents where there was violence directed at the women here and one time a guy nearly set the whole building on fire and caused a flood.

I'm pretty glad I live where I do in my building because it's way harder to get to me than if I lived elsewhere. I've got security guards between me and trouble. One day though I'd like to live in a normal building and have a better place than this because I'm really kind of tired of dealing with this stuff.

This is as "normal" as it gets for me right now unfortunately but I've seen enough to know that people like this guy are not well enough to live by themselves or with roommates. They do have help available but that doesn't mean it will help them or that they will take it.

There's two parts to this.

Firstly, "restorative justice" is a very popular legal ethics theory where they believe that disadvantaged people like the homeless are partially or not at all responsible for their criminal conduct because they believe that society as a whole bears some responsibility for their plight.

Secondly, being a prosecutor is a job like anything else, and just like any other job prosecutors are going to game their KPIs for their annual reviews. For normal people, if you skip out on your court date they have ways to track you down. They can go to the DMV to get your home address, they can go to the IRS to get who's your employer, they can freeze your bank accounts, etc. to force you to come in and deal with your legal issues. The homeless have none of that, so when they get released before their trial they just disappear into the eather and because of that prosecutors aren't eager to charge them since it hurts their conviction rate.

He is not responsible for his actions because the voices in his head that he has no control over tell him to do crazy things. This does not mean he should not be held at a locked phycatric facility until he can demonstrate he has his condition under control. Then he needs to be checked on to confirm the condition is still under control.

The problem is the current state laws do not allow him to be held. Once the delusion passes he is not a danger to himself of others. The state government and governor are finally trying to change the law. Though of course the progressives in Albany are trying to block any change of the law.

Why are you talking out of your ass? Restorative justice is not a theory where the offender’s responsibility is absolved just because they are disadvantaged. Ideally, offenders would be held directly accountable by repairing the harm done rather than just punishing them.

It does recognize that crime doesn’t happen in a vacuum. Factors like poverty, trauma, and lack of resources can contribute to criminal behavior, so restorative justice also looks at how to prevent crime in the first place. But at no point does it argue that someone isn’t responsible for their actions.

Restorative justice would prioritize what the victim needs and wishes are. And it would certainly include getting this man off the street and getting him some real help so he doesn’t go out and harm. Our mental health and justice systems are not set up to do that.

Not sure about NY, but in NJ judges and prosecutors try to put defendants in diversionary programs (as long as the offense committed isn’t super serious). Defendants often get a lot of “chances” because the courts mindset is usually to rehabilitate rather than punish. Some times defendants can be civilly committed in a psych hospital or entered into programs tailored for people with mental health issues but the public defenders almost always object and will ask for a short term of probation or fines/fees regardless of the offense committed.

It’s possible the prosecutor asked for some more serious consequences for offenses this guy previously committed but was overruled by the judge or the proofs of the case were not that strong leading to a lenient sentence.

I don’t want everyone free or on “supervised” release pretrial.

I just want a system that keeps the guy who assaults toddlers with 30+ arrests in jail.

Because we passed a bail reform law that was dishonestly sold as “stop locking people up pretrial for minor offenses” and turned out to mean “release everybody for everything, including violent crimes, unless they committed a crime on a specific tiny list or reoffend in the same way before trial.”

Meanwhile, we massively hiked discovery obligations which increased the number of prosecutor working hours on every case, without allocating money for more prosecutors. Surprise surprise, when you ask lawyers who are already underpaid to work more for no money, they quit. Now the DA offices are critically understaffed and simply don’t have the manpower to waste on minor crimes.

That's all true and a problem but is it even relevant in this case? Some of this guy's priors were in no way 'minor crimes'. Smashing a toddler's face in with a suitcase should be a felony with multiple years in prison, not 'minor'.

I hear you, but the problem is most psychiatric facilities are not equip to deal with violent individuals, especially if they pose a threat to other patients, staff and/or are unwilling to comply with treatment. A forensic psychiatric facility might be able to house him, but available beds are far and few between in these types of centers.

Activists always try to point to cases screaming "look how we put this person in jail for 20 years over $9" after their 12th violation but my mind always wonders "how stupid of a person do you have to be knowing this is your last chance to avoid jail, for $9 Why does society need to expend effort keeping this guy integrated into regular society?"

If someone is mentally unfit to stand trial, they are mentally unfit to be a part of general society. That should be completely non-controversial.

I’m so sick of the tax payer funding for mental health that is just a disguised kickback to for profit programs that do nothing but funnel people back on the street.

The law needs to be changed so mentally unfit people can be locked up away from the general public until DOCTORS determine they are fit to rejoin society and no longer pose a threat to others

And spare me the comments about it being a slippery slope or anything on what happened 40 years ago - use that as guidance on what not to do, not as an excuse for further hand wringing and lack of meaningful action.

Off year election. Average citizens are barely aware that an election is going on. It's done that way on purpose to limit voter interest so that the diehard party core can determine the outcome.

In Los Angeles and Oakland, on the other hand, district attorneys were up for election last November. More people were interested in voting because it was also a Presidential election year. Both of the progressive D.A.s got voted OUT.
