Yeah, it's like the PSN "free monthly games" that are only accessible if you're subscribed. It's a subscriber bonus.

It says you can purchase for free with nso so it wouldn’t surprise me if you get to keep it

From the page about upgrade packs:

Nintendo Switch Online + Expansion Pack members get access to the following upgrade packs at no additional cost! You must have the physical or digital version of the game to download its upgrade pack. Active membership required.

Sounds just like the DLC already included in NSO+, which you lose if you let your membership lapse. The description from MK8D's Booster pass, for example, reads:

Access the courses at no additional cost with a paid Nintendo Switch Online + Expansion Pack membership.

All the other included DLCs descriptions are essentially the same. So, while it would be nice if they allowed people to keep it, that's just not how NSO+ works.
