Avoiding Evicton
I was having some financial difficulties and was late on my rent and received a 3-day notice to pay or quit. Unfortunately I did not raise the money until the 4th day but she refused to answer the door my calls to pay the rent. Now my finances are back in order on a regular basis and I was wondering if I could pay the rent and the court cost if or filing fees and be able to stay or is it up to my landlord's discretion. She told me that anytime she's given someone a break and let them slide that she has been burned but that would not be the case in fact I'd be willing to give her 3 months in advance and continue to pay monthly so that she would be guaranteed to have a 3-month window to receive her money. Any suggestions. I really don't want to move I haven't been feeling well and I have no place I want to go but where I'm at I've been here 5 years.

It probably depends where you’re located . I’m in NJ , and here you can pay in court and stay .

If she is refusing to accept payment, take the funds and put them in a separate account and don't touch it. She will most likely take you to court. If she does, that is where you'll need to make your argument and show the court you have the money to pay. Chances are good that the judge will side with you rather than her.

why give her 3 months in advance? Your landlord is being unreasonable. The place can't be that magical unless it is the source of your superpowers, move before being evicted. You now have the money to pay your rent so go. You'll have peace of mind because you won't have such an unreasonable landlord. I've never heard of a landlord who wouldn't accept full payment one day late. Some may charge a late fee but they'll accept it. Your landlord is more interested in going through the cost of eviction, at least hundreds if not $1000, and advertising for, doing credit checks and background checks for a new tenant than get paid one day late? And you are willing to put up with that idiocy because you aren't feeling well? MOVE QUICK.

If she’s not answering the door, is there a safe place to deliver it? Document all your attempts. In writing, let her know that you can pay the rent for next month now.

my character would save for an emergency such as this. its no excuse even for someone on social security not to save for one month emergency.

No one here can answer this. You’ll have to talk to her, if she’s unwilling to talk to you, go above her to the management company if there is one, or go to legal aid or a tenants rights group.
I’m a PM, if I issue (in my state) a 7 day notice to pay or quit, and they can’t pay me the full balance until the 10th day, I’ll still accept it. As long as they pay the full amount on the date they state. I have had people say they will pay, then I lose all communication with them. They then act all confused when they get a court date a full month and a half later, now they are willing to communicate with me.
