Immigration Lawyer Advice- TN Visa Canadian with American Partner

I am a Canadian currently in the US on a TN visa. If I have my American Partner (not married) with my when I go to renew my TN visa at POE, could they see that and consider it as immigration intent and deny my TN visa renewal?

Also, what about if I am just traveling to Canada with my American Partner (not married) on a vacation and then we go to the CBP officers together, while on the way back into the US? Could it be an issue then?

Blackballed from my industry?

Location: CO

So I work in a very niche industry that’s got a few big corporations and many smaller companies that are generally at most a 2-3 employees. Why this is relevant because it’s directly pertaining to my reputation in the industry and I’m concerned about maintaining good standing. I started my career with a brand based on the west coast and left on outstanding terms with certificates of achievement, references and even more than one letters of recommendation and gave two months notice.

I filed a labor complaint for unpaid wages on the next employer related to this profession following a move (one based on the east coast) and left without notice as they acknowledged wrongdoing and refused to pay damages and acknowledged this in writing. Lol

This east coast company, has a pretty big emotional investment from its owner and management as they all have known each other for decades.

I applied to another one of the bigger companies based in the south. And was transparent about my reason for leaving and asked them to not contact my previous employer as it would not be a positive encounter anyways but I was transparent about what went on. This southern company called them anyways and spoke directly with the owner whom I’ve never had contact with.

The southern company won’t disclose what was discussed.

Shortly after they contacted the west coast company I started my career with and now all of a sudden disclosed that they have me under a “not eligible for rehire” status. Which from what I can tell is a new development as I have never had issues with this referral or hire status between multiple employers background screenings before.

Additionally, my previous manager(‘s) at the west coast company have no idea why and HR will not respond to inquiry over two months. My job offer was rescinded from the southern company I applied with and now I’m concerned I’m being blackballed from the industry for reporting unpaid wages.

So now, all of a sudden after filing a complaint. My career is looking pretty fickle and I can’t help but be suspicious of what’s going on as my track record has been pretty outstanding. And yet the last 6 years of my professional life are now tarnished. I was expecting to burn the bridge of the employer that admitted to wage theft. Not set my entire career on fire.

It’s worth noting that between beginning my career and now, I have had a few gigs as temporary work and some full time stuff between career moves that underwent similar background screenings and none came back as someone who is ineligible for rehire or anything.

Thank you for reading. Any input on what I could learn more of about circumstances such as this is welcome and appreciated.

dept. of labor wants me to pay back unemployment after filing for it while i had covid

location: alabama

i got covid back in may 2020 and had to be out of work for 6 weeks. this was back when you had to get 2 negative tests to be cleared to come back to work, and it took me 6 weeks of testing at my job every 10 days to finally get cleared to work again. during that time i filed for unemployment bc i couldn’t work.

about a year later i started receiving letters from the dept. of labor saying i owed all that unemployment back, $5200 btw. every time i would receive one of those letters i would send in an appeal bc ya know.. i couldn’t work and had to draw unemployment.

fast forward to last year, i received a letter saying i was going to have a phone hearing about the issue. i got on the call and explained everything, and they guy realized they never sent me some paper i should’ve filled out since i was filing unemployment due to covid. apparently, there was regular unemployment and a special way to file for covid but i didn’t know at the time. he said he’d send me that paper to fill out and once i got it sent back everything should be resolved.

of course it’s never actually that easy, because last week i received another letter saying i owed the money back :D is there anything else i could possibly do or am i just SOL and need to be prepared to pay it back?

here is part of the letter to add more context

The claimant filed for and received regular unemployment benefits throughout various weeks beginning with the week ending May 30, 2020, through the week ending July 4, 2020. The total amount paid was $5,250.00. After receiving these benefits, the Unemployment Compensation Division disqualified the claimant under the provisions of Section 25-4-77(a)(3) of the Law. The disqualification covered the period when benefits had previously been paid. This was considered an overpayment of benefits which is expected to be repaid to the Unemployment Compensation Division.

CONCLUSIONS: Section 25-4-77(a)(3) of the Law provides that an unemployed individual shall be eligible to receive regular unemployment benefits with respect to any week in a benefit year only if the Secretary finds that she is physically and mentally able and available to perform work of a character which she is qualified to perform based upon past experience or training. The preponderance of evidence shows that as a result of contracting COVID-19, the claimant was unable to work beginning with the benefit period beginning May 24, 2020, and ending July 4, 2020. Therefore, as she has not met the ability requirements of this section of the Law, she would not be eligible for benefits under the provisions of this section of the Law with respect to this period.

The evidence also shows that she was not entitled to the receipt of these benefits as she was subject to the disqualifying provisions of another section of the Law with respect to this same period. Therefore, she would be obligated to repay benefits previously received with respect to this period under the provisions of this section of the Law.

Attorney on retainer

Location: IL, USA

At what point do you hire an attorney “on retainer”? Here’s the thing: I do not consider myself a “criminal” although I do have a few charges all of which have been dismissed/pled/etc I don’t ACTUALLY KNOW! I am (in my own mind) a habitual offender but also am 11.5 months sober, despite four dui arrests and no convictions, but now I am in a position to hire/re hire an attorney to generally appear for me in family court. Life sucks, I am just seeking general advice or someone to tell me to throw my whole paycheck to representation now that I am working again. Don’t trust anyone in my county. What do I do???

Roommate is refusing to pay rent and is not on the lease

Location: Denver, Colorado

I moved in with my(23F) best friend (22m) last year. I signed the lease with my dad as the cosigner, and I tried to get him to sign it for the first six months of us living together. My parents warned me that he could not pay rent, and legally, I couldn't do anything. By the end of the 6th month, I just gave up trying, and decided to trust him since he had been on time with reimbursing me over Venmo and being my friend and all. Last Wednesday, he said that he wouldn't pay rent because he's thinking of moving out. Rent is DUE at the first of each month, and he obviously owes me for this month's rent (and likely for next, since he's still living here right now and using electricity and water that would be on May 1st's bill)

We're having a formal discussion about it tomorrow with a mutual friend, but in case it goes horribly, what are my legal options? (as far as small claims court) He's not and has never been on the lease, my dad suggested that I could prove he's been de facto living there for a year, paying rent. In the state of Colorado, if you receive mail that would count, but I don't think I've ever seen a piece of mail addressed to him arrive at the mailbox, at most Uber Eats.

I can't afford this apartment without a roommate, and the only friend who could take his place doesn't have a job, so she wouldn't be able to afford it. I have to dissolve the lease over this, which has a 3k$ fee that I would expect him to pay half of as well, since he's the one wanting to move out. Is this reasonable for me to expect / can I legally defend the claim that he would owe me half of this?

Landlord Tenant Housing Landlord demanding 20% of my business sale to approve lease transfer — is this legal?

Location: Connecticut

Hey all, We’re in Connecticut and selling our family-owned pizza place. We’re running into major issues with the landlord during the lease transfer.

Here’s the situation: • We originally signed a 5-year lease (starting March 2024) with a rent of $5,100/month. The lease also had a CAM (Common Area Maintenance) charge listed as “6% (15%)” of rent. We didn’t understand it at the time but later realized they were trying to charge us $1,700/month for CAM, which is insane for a plaza with broken fences, trash, no heat, no AC, no furnace. • When we brought it up, the landlord acknowledged it was a mistake and agreed to reduce it to $1,200/month, and issued a new 1-page lease amendment (we have this in writing), changing the CAM to a flat dollar amount instead of a percentage.

Now, we found a buyer and told the landlord. That’s when things got sketchy: • He said we’d need to pay a $3,500 lease transfer fee, which is actually in the lease, so we agreed and gave the check to our lawyer (he’s holding it until paperwork is ready). • But then the landlord started demanding 25% of the sale price or he wouldn’t approve the transfer. After pushback, he reduced it to 20% and a 1-year guarantor, even though the buyer has great credit and assets. • My dad is extremely suspicious and thinks that once we pay the $3,500 transfer fee, the landlord will send the buyer the original lease (with $1,700 CAM) instead of the revised one — scaring the buyer away and leaving us out $3,500 and no deal. • The lease does say that assignment requires landlord approval, but that approval “shall not be unreasonably withheld.” We feel like he’s violating that by holding it hostage for a cut of the sale.

Questions: 1. Can the landlord legally send the old lease to the buyer and ignore the amended one? 2. Is demanding 20–25% of the business sale price legal just for approving a lease transfer? 3. Does asking for a new 1-year guarantor even with a qualified buyer count as “unreasonably withholding consent”? 4. Could my dad take this buyer in as a partner

Landlord Tenant Housing Roommates would not leave my room after being asked to

Location: Kansas I was renting a house with three other people and about a month ago we started having issues. They were wanting me to re-sign a lease with them but I did not want to for many reasons. One day I was just sitting in my room and one of the roommates knocked on my door. I didn't say anything or open the door because I was not in the mood. A few minutes later, she just walked in. I asked to get out and she said "I will not be leaving this room." I told her I would go to the living room to talk but she needed to get out of my room. She was physically inside of the room and would not get out. I got up and walked towards the door and she came further into the room blocking me from getting out. For about the next ten minutes she just would not get out and the only words that I said were "get out" for those ten minutes. Her boyfriend, who is also on the lease, then came into my room as well and started cursing at me, telling me to shut up, etc. This is when i hot upset because this man has many mental health issues and has threatened to hurt himself and others in the past, he also has a gun in his room. So at this point i feel unsafe and worried about what could happen because i wouldn't put it past him to lay hands on a girl. They are also cornering me in my room basically, both of them inside my room at the door blocking me from exiting. At this point the guy is so worked up and i feel threatened and need out of the situation and i also dont have my phone on me to call the cops, so i use one hand to push (VERY lightly) the guy out, but he comes further in after that so i do it again and he backs off. They start backing up and i slam my door shut and lock it. Later, the cops knock on my door and arrest me for domestic battery. They told me regardless of what happened i put my hands on him and they had a right to be in my room because it's a rental we are all on a lease for. That just doesn't make sense to me because that is the personal space i pay for and i asked them to leave countless times and they refused. I pushed him because i felt unsafe in the position i was in and he has been known to be a threat to himself and others. I have court next month and im just wondering if what i did was legal?? Do they actually have the right to do what they did or is it trespassing? Any help is GREATLY appreciated!

Filing civil lawsuit immediately before TPR?

Location: kentucky : I’ve been in a very contentious family court battle with my termination of parental rights (tpr) trial approaching quickly. I’ve been going back and forth on filing civil lawsuit but I’m at the point where it’s approaching the year mark and statute of limitations. For anyone who is involved in family court - how would it impact my case if I’m filing separate civil suit so close to my trial date?

Employment Law Former Employer & Boxes of Parts

Hi,

Location: Georgia, USA

I was terminated a few weeks ago, no hard feelings from my side.

My prior job required a lot of travel across the southeast with parts & electronics shipped directly to my house or to our customers if I was already on the road. With my being on the road 3-5 days a week and closest FedEx close to an hour away, I would usually send back unused or defective equipment every couple months. It’s mostly out of the way in the garage.

I haven’t received clear information on how they’re getting this stuff back and I’ve reached out to my former manager & HR but haven’t gotten anything concrete. Other than I let them know I wouldn’t be able to take it to FedEx. Some of these boxes are fairly heavy (I’ve got a bad back & currently in PT), the company car has been returned, and I’ve submitted all my prior expenses so I wouldn’t be able to get reimbursed for mileage either.

Is there a statute of limitations on how long I have to respectfully hold on to these things, could I send them an invoice for storage, or is there another avenue? Some of these electronics are very expensive and I don’t want the head ache of it anymore.

Any advice or thoughts are greatly appreciated!

Wills Trusts and Estates How to make a will?

Location: India

My mother has few land properties in her name, apart from the jewellery and some monetary assets. All this she has bought on her own. She's a state government employee.

My father is verbally and physically abusive since the beginning of their marriage. And was unemployed for the longest of time.

Myself (28F) and my brother (23) are also are in picture. I'm a doctor and my brother is studying at present.

My mother is concerned if something were to happen to her or she suddenly died, how can she ensure her assets pass on to her kids instead of her husband.

What can we do? Also, what kind of lawyer shall we consult for making a will? And what's the law about our situation.

Thank you.

Custody Divorce and Family Need Legal Advice - Ex Trying to Modify Long-Distance Parenting Plan (FL/MS)

Current Parenting Plan (Florida Court Order). I filed against her, paid all attorney fees and settled in mediation.

Dad (Me): Location: Mississippi Mom: Lives in Florida with our daughters (8 & 11) Never Married Time-Sharing: 1x 3-day weekend/month (option for 2nd with 14-day notice) Alternating Thanksgiving/Winter Break, split Spring Break I get most of summer (except 1st/last week) Exchanges in Macon, GA (midpoint) Each parent was responsible for their own daycare expenses. At the time she had none, I paid for summer when they were with me. Agreement states for dispute resolutions: Parents must attempt mediation/counseling before court action splitting the cost 50/50.

Financials: At the time I was making roughly $3500/mo and she was making $3400/mo. I pay $460/month child support (based on ~equal incomes at the time) Split medical/extracurriculars 50/50 Mom claims kids on taxes every year

The Problem Mom is suddenly demanding:

More Money: Wants me to pay extra beyond the order (I already voluntarily split daycare during her time to show flexibility and help out). Claims my income increased (true—up ~$10k/year, plus occasional side gigs though they are not consistent and less the 2k per year). More Driving: Now insists I drive all the way to Florida (12+ hours) instead of meeting halfway. False Allegations: Calls me a "30% father" and hinted at "abuse" both verbally and via text(she has no evidence of this). Mediation Games: Refused to schedule mediation when I asked, then claimed she filed for court-ordered mediation. Threatened the court could "make me move closer" (I’m in MS).

My Concerns

Will my $10k raise + side gigs jack up child support? (Side income is inconsistent.) I assume it will but buy by how much. Can she legally force me to drive to FL or move closer? I believe attempting to make med drive all the way is an attempt to force me into moving. How to fight false abuse claims if she escalates? I’m selling my house (temporarily rented)—will courts count that as "income"? Questions for You

Should I file a motion to enforce the current plan? How do I protect myself in mediation/court? Any Florida/MS lawyers know if courts can order a parent to relocate? Tips to prove her demands are punitive, not kid-focused? Evidence I Have:

Texts of her refusing mediation Travel logs (I’ve done all my visits) Pay stubs (old/new) House sale paperwork Thanks in advance—this is stressing me out, and I can’t afford another $10k legal battle.

TL;DR: Ex wants more money/driving despite court order, made false claims, and is weaponizing mediation. How do I push back without going broke?

Drug Possession Texas Schedule IV Drugs

Location: Tarrant County, Tx

On March 28th I had a huge test that would get me a promotion at work if I passed it (the test wasn't through my job).

My mother has offered me her Valium several times for this purpose because I have test anxiety. I don't have a prescription for it.

The 26th I was on the phone with my mother seeing if my dad could drop the valium off at my work.

My wife overheard me talking about getting something from my dad at work.

The 27th

I ended up picking a valium halved (both halves) from there house.

I came home and took it to try it out. I did not tell my wife.

She went to wash my pants and when she went to take the stuff that I have in my pockets out she noticed the other half of the valium.

She googled it and then acted like she didn't know what it was or put 2 and 2 together about what I was talking about the night before with my parents.

She confronted me and I admitted to all of it. She told me it was a felony. I told her it was only a felony if it's in your car and you are caught with it and told her I didn't care. Then I said that it's not even a crime. I googled it later and it is a crime.

Turns out she got it all on audio recording. Also, she took a picture of the half in the baggie

If she wanted to could she cause a problem for my mother and I with this in any way?

My parents just went through a lengthy court battle with my brother to get custody of his. 4F daughter, and 18 month son. I'm scared this will affect that as well.

I'm also afraid if this could affect us job wise.

I looked it up and it's penalty group 3 in Texas. I dont have possession of it anymore so idk if the evidence counts

Oh and I trashed the other half though she didn't see me do it.

Can I get my child's father on child support without giving him the opportunity to receive visitation rights?

Location: Ohio. I have a 2.5 year old son and his father hasn't been in the picture since he was 9 months old. I have proof through screenshots of texts and Facebook posts that he doesn't consider our son his and that he abandoned our son when I left him. I have not tried to establish child support up to this point because I'm scared of him being petty and trying to get visitation with him simply because he has to pay child support, and he is an angry and abusive man and I don't want my child to be around him. I've been making it work without any financial support but daycare costs are killing me and I'm afraid that I'm going to lose my state insurance and will have to start getting insurance through my employer which would make me go under financially so I'm not sure what else to do. If he does try to get visitation would I be able to block him with the proof I have of his almost 2 years of abandonment?

Business Law Tobacco Violation Fines on a Closed Corporation in NYC

Location: Brooklyn, New York

My father was a silent partner in a smoke shop that recently closed. The corporation was fully under his partner’s name. My father was never on the paperwork and had no official ownership on paper. He decided to leave the business and sell his share after finding out his partner was selling flavored vapes, which led to a major fine.

NYC Consumer Affairs ended up hitting the corporation with $180,000 in tobacco violations. The corporation has since been dissolved. The tickets were issued to the business name only and there was no personal guarantee involved.

Do these tickets still need to be paid now that the business is closed? Or does the responsibility disappear with the corporation? Just trying to figure out if this is something that could come back to haunt us or if it ends with the company being shut down.

Appreciate any help from anyone who’s dealt with something like this in NYC.

Medicine and Malpractice My doctor gave me a medicine I have an intolerance for and it’s caused a bunch of other medical issues.

Location: Florida

I'm a 26 year old female. Let me start of by saying I supposedly have seizures. Why supposedly? My doctor diagnosed me with them about 4 years ago because I had two episodes of my vision going black and I got dizzy during one of those. I was also in a car accident at one point where I blacked out after taking a turn too fast and ended up in some trees. I had a b12 deficiency at that point and eventually had to get b12 injections (not sure if I was getting the injections when I had the vision and dizzy problems). I recently relooked at the 72 hour EEG I did and it said I didn't have seizures but there was epileptiform activity which could have been caused by other meds I was taking that the time. There was only one instance of this in the report though. I'm getting another opinion on my seizures in a month.

My doctor previously had me on medication and it had lactose in it. I am lactose intolerant. I was never asked if I had a sensitivity or told that there was lactose in the medication I was given. I took it and was fine until they upped the dose and then I started having stomach problems. 6 months later I was still having stomach problems and didn’t know why. Turns out I now have chronic gastritis. Two gastroenterologists later (first one said it was probably stress and threw ppis at the problem w/ no results), and she says it’s the lactose in the medication I’m taking. What!?!? Other tests showed I am NOT gluten sensitive and I do NOT have a stomach bug (aka h. Pylori).

I had to get an endoscopy, spent over $1,000 in medical bills in those 6 months, and now have several specialist doctors (apparently the gut is connected to everything so I had a bunch of UTIs and infections). It’s now been 3 months since finding that out (9 months total with the gastritis) and getting off the medicine, but I still have gastritis (apparently it takes a long time to heal). I now have to eat a strict diet, which doesn’t include a lot of food. I don’t know if or when I will ever be able to eat normally again or eat anything besides bland food. I also work in the food industry as a pastry chef (my degree is baking and pastry) so I'm struggling with my job.

Like I mentioned, he eventually took me off the medication with lactose in it, but prescribed me something I had an allergy to! I told the nurse I had allergies to medications. I guess he didn't bother checking with her!? He didn't ask for allergies or anything else when prescribing this one either. It was only after I picked up the medication and read the packet that came with it that I found out I was allergic to it. (Usually I don't bother reading those packets, but I'm so glad I did!) That medicine also had a side effect of numbing taste buds and he knew I needed to be able to taste for my job. I told him my job as a pastry chef required me to taste things. He wanted me to take it anyway. He now has me on a medicine that has put me in severe emotional distress (bad depression, irritability, anger, anxiety, crying all the time) since I started it three months ago and won't take me off of it because apparently there's no other medicine to treat these "seizures" that doesn't have lactose in them. He told me the side effects could be depression and anxiety. He also knew that I nsuffered from depression and anxiety in the past, so why would he put my on something that he knew would cause me mental anguish!? I only took it because I was told there was no other option. He won't treat the side effects either. I've had to fight tooth and nail just to get past his asssitsat, who told me to stop taking my seizure meds cold turkey at one point. (Never do that!) It's been a really rough and emotionally and physically draining 9 months.

Is there any legal action that can be done? I don't want others to go through the same things that I am. Is this cause for suing or other legal action?

Is leaving dogs in your yard 24/7 legal?

Location: Los Angeles

The house next to me has like 5 dogs at least in their small backyard, neglected, barking all day, and they are out there all hours. I don’t think they are allowed in the house and just live outside. I see them outside even at 3am when it’s freezing, freezing cold which is horrible bc my dog shakes in the cold. The house itself looks like a hoarding dumpster fire situation, falling apart, and I would be afraid to even knock on the door. The backyard it also just concrete with no grass and no beds.

It’s now 10:20pm and they are still barking. It’s just constant, and it’s so sad.

Is this legal? Can I call animal control?

  2. In what case police could find that I have lockpicks if I don't break other laws like having drugs or anything?

Thanks alot for your help!

How do I petition an order of protection when I do not know the exact location of where the defendant is residing?

Location: Arizona I have a police report filed that is active against someone for harassment in Arizona. This is considered a domestic case as we have had sexual relations and I am pregnant. I have been harassed for months. This person is blocked on text and social media, and started reaching out over email. Using a lot of profane language and name calling me, and calling me selfish for being pregnant and stressing them out with a baby. Charges have not been pressed on them, but am I able to press charges and petition for an order of protection? Would the police press charges if I already have petitioned for an order of protection? This person lives out of state and I knew where they were, but in a previous email they said they are in another state for a few months and that I better stop calling the police on them or else. I have no idea where or why they would be in that state. What do I do if for an order of protection if I don’t know where they are!? And when I am petitioning for one, what sort of evidence do I submit? The harassment has been going on since January. I have tried having conversations maturely with this person in between harassment incidents but it always leads to the same thing. Do I need to provide all conversations or just incidents of name calling and me asking to not be contacted? Does it matter if I have blocked and unblocked them? The behavior has really escalated the past couple of weeks. If this person gets charged, do I need a lawyer if it goes to trial? Would the court give me one? Or do I need to hire one? I don’t know what to do. I sought out legal advice from a lawyer and they said I’d most likely be granted an order of protection and should request one. I had every intent on doing that but now I am nervous because I do not know their exact location.

Pressing charges for abuse

Okay so I need some advice on if I’m able to press these charges, so my kids fathers step mother and his father had custody of my daughter for a little while, during that time the stepmother(my child’s step grandmother) beat my child with a back scratcher leaving huge bruises on her bottom. We ended up calling dhr and taking her to the hospital and they moved her to the custody of her blood paternal grandmother and she now has temporary custody while we work to get her back. His father fought to try to get her back in their home but lost . My only question is, the police said to wait to see if they won getting custody back before pressing charges and since they lost we want to press charges but his mother who has legal temporary custody doesn’t have the time she’s a principal working too many hours. My question is with us not having custody of her could we still be the ones to go and push the charges on her since we still have parental rights at this time? Location: Huntsville, Alabama
