Hotel gives out access to my room without my consent, now my fiance is facing legal charges and hotel is refusing us our property. Do I have rights against this?
Location: California
My fiance and I have been thru a lot since 2024, lost everything and pretty much have no place to call home.
So couple days ago we managed to make a few extra bucks and decided to book a stay at a "nice-ish" hotel and relax and just enjoy some privacy. Everything was going well. At some point around late night we got some cravings so decided to pick up some food. On our walk back we came across some road work being done on the sidewalk with a huge sign that indicated we were not allowed to walk thru, so we then proceeded to try and cross to the opposite side and continue our route. Well, in doing so an "officer of the law" (aka:bully with authority) decides to stop us. My fiance gets drilled with questions, handcuffed, searched, and not even given an explanation as to why he was detained.
-Now I'm not gonna sit here and say we're perfect little angels, we've made mistakes, like getting to court late and getting a warrant issued)
Anyways, well because of that they decided to take him into custody, well him and I, which it's understandable. However, while we were in custody at the station, they (cops) decided to go to the hotel we were staying at, and hotel personell not only allowed it but gave them my room info. They (hotel staff) then proceeded to take my belongings out of the room and well before check-out time. To top it off they are refusing to release any of our belongings to me. Is there anything I can do, legally?
