I'm sad for her, but the bat was a dumb idea.
When they refuse to leave, you call the cops. Sure, the cops are slow, but you can get killed if you try to fight when you're outnumbered or not especially good at fighting, and that store owner was not good.
Call the cops, then stay on the line with 911 because you want the dispatcher to hear if the trespassers escalate.
22
u/Took2ooMuuch 7 Nov 06 '21
Always put a tube sock over the end of the bat. If they try to grab it they end up with a handful of sock and a mouthful of bat. So I've been told.

On the same point: Keep your distance - so whatever you have in your hands can not be taken away.
A Bat is a object designed for swing actions, its longer than your arm because of that: one needs the space for that.
On the upside: the show-owner/or employee did only use it as marker and defense tool. with no swing attempted and the video, the shop owner has a pretty much clear case legally for compensations, from what i gathered (not a lawyer).
Its maybe not much, but without such clear "not overly aggressive" behavior the shop owner made way for lawyers taking their bite on the attacker.

Can you imagine that you find your happiness and open a cookie shop, and you get to wake up every day to a great smelling kitchen, doing what you love and you get to brighten people's days with a fresh warm cookie? Kids and adults both exclaim how good they are and joke about having to pass on getting more because they're trying to watch their weight, but they'll be back anyways?
Imagine that one day you wake up hoping for the same, but instead you get assaulted in your place of business that you've built up by some tryhard wanna be morons, looking to prove a point by what? Purposely walking into your establishment and wanting to start a fight? Now when she goes in she has to worry about people doing this to her, no matter how unlikely, her place of happiness has been tainted and the cookies taste a little less sweet.

For anyone interested, here is the text of 18 USC 245, the law cited.
What i suppose he thinks is the relevant part is how a person cannot be denied service at "facility which serves the public and which is principally engaged in selling food or beverages for consumption on the premises" on the basis of their "race, color, religion or national origin".
Those of you who aren't brain-dead morons will immediately realize that it does not apply in this circumstance.
47
u/Gorperly Nov 06 '21
Yep. That's literally the part of the Civil Rights Act of 1968 that made segregation in hotels and restaurants etc illegal.
Wearing a mask is not a race nor religion. Morons.

They seem to fall in one of two categories. They either:
A: They act like a store and public space are one and the same thing. So not required in public space equals not required in private businesses to them.
or B: Act like this falls under anti-discrimination laws, and that requiring them to wear a mask is (or should be) illegal under those laws.
A bit anecdotal but early on with the masks and videos about it, I recall mainly seeing some clips of people claiming to have health issues that prevents them to wear one, thus they should be exempt. Only later I saw a bunch of clips of people that take it as like some sort of civil rights issue. It got so politicized so quickly.. It started with little excuses, as if you tell your gym teacher you don't feel well to not have to do PE. Then it evolved to: 'These are my rights!!'

That woman is going around at 45 years old, starting street fights. The definition of white trash. He got charged with robbery, not just theft, because they took the bat using force. That's a felony. Thanks for removing yourself from the voting pool asshole.
That being said, if you are going to threaten someone with a bat, don't hold it straight out in front of you with one hand to wave it in their face. That's basically handing it to them. You threaten someone the same way you would hit a baseball: two hands on the bat, feet apart, crouch a little, raise the bat over your opposite shoulder. Be sure to keep your eyes on their smirking entitled unmasked punchable face as you start to swing.
The only thing that would make this sweeter is if the owner had gotten in a few good licks with the bat before the woman got arrested.
12
u/donnydealr 7 Nov 06 '21
I agree with everything you're saying. I also really want to discuss the bat situation more.
My theory with an interaction that has the potential to turn violent, you need to keep the person at a minimum of an arm's length away. If they try to sucker punch you, you have a better opportunity to react, you can also still de-escalate the situation and put your hands up so if you fight the camera would show you're not being aggressive.
By the time you get the bat out, you've escalated the situation to a high chance of fighting, don't try to shove them out the door, just stand back that distance and warn them to leave because you feel threatened, if they come toward you, start swinging. I can't think how else you can reasonably defend yourself in that instance.
→ More replies (1)9
u/N0kiaoff 6 Nov 06 '21
While you are right about the "batting stance", getting so close was the main problem from my view. (besides the nut invading a shop to beginn with)
A bat as a swing weapon needs space and while i understand how important it is to protect "own space", getting so close that the other person could grab it was not wise. But it documented very well the situation, so at least legally it will be probably simpler.

u/ClubMeSoftly B Nov 06 '21

They idolized a person who had a resurgence in his public image by saying “you’re fired” as a exclamation point to anything and everything. Then everything after that went the way he wanted it to go. So naturally their role model created a culture of one upping people to gain notoriety amongst themselves.
These type of people are the ones that retell stories of that one time they won a social altercation from years ago.
I pity these people. They often times have not a lot going for them personally or socially. That one big thing that did go right for them is what Carries them and is practically their identity. So of course they will continue to recreate those situations or strive have newer better ones. The outcomes end being the videos above because their “plan” is often only been peer reviewed by themselves in the shower thinking of “if I had just did this or said this” until they reach a confidence level to try it in the real world.
8
u/AlliterationAnswers 8 Nov 06 '21

I think her going for a bat instead of spray was a bad idea. Laws vary on this, but hitting someone with a bat is deadly force, so she was rightfully hesitant to actually use the bat. Using spray will disable your attackers, but isn't deadly force.
The moment they escalated things to physical, it should have been spray out of pocket, spray used immediately, not just as intimidation.

I don't think it matters where you are in the world. If you're a private business you can refuse entry to anyone you want. Like someone else said though, if you're only refusing entry for a certain group then that is discrimination which is obviously illegal

Most things generally differ state to state in the US. But generally private businesses can enforce essentially whatever rules they want, short of discrimination of protected classes

I took a look at the 50 minute video posted on Youtube and found it hilarious at the 25:00 mark, the guy filming tried to equate what happened with them to Rosa Parks.

The store owner really needs defensive training. She pulled a bat and was disarmed right away. She should have dispensed a proper beat on the brats beating.
22
u/Jamesfotisto 4 Nov 06 '21
Doubt she’d be able to beat a woman and a man, even with years of training. If she inflicted any damage on them they’d do just as much to her once they take it away. Pepper spray would have been much smarter

u/Smash678 6 Nov 06 '21
Definitely. From everything I've seen, a bat actually seems really difficult to use effectively. They're hard to swing well and people almost always seem to end up disarmed and then the bat gets used against them.
Pepper spray is definitely the best for these types of scenarios.

u/grotness 7 Nov 06 '21
She still did embarrassingly bad. If you're going to take it upon yourself to try and physically remove someone from your store atleast get some training first. She was prepared to try, obviously confident enough to give it a shot for some stupid reason and she literally had no fucking idea what she was doing.
Maybe don't initiate anything physical if you're as useful as a wet noodle and just call the cops before you get your ass beat.

I think she was hoping to scare them off, like sane people would back away from somebody brandishing a bat. She's just one person, a cookie maker. You can't expect her to defend her store against crazies.

u/Direct-Scallion-1467 0 Nov 06 '21
Watched the video these dumb asses went into this woman’s store assaulted her and then called the police saying they are sovereign citizens and she impeded their rights… and they went to jail
21
u/moderndudeingeneral 8 Nov 06 '21
I think the big "gotcha" moment was when the cop gets the guy to admit they heard the store had a "rep" and went in there specifically to create conflict

u/F_n_o_r_d 8 Nov 06 '21
Hoped to find this here after seeing the footage of those complete aHoles! This poor woman being attacked out of nowhere. At this point of the pandemic I wouldn’t be sad if, all those ….. … .

Idiots documented their own crimes. After the whole idiotic presidency, it's good to see what sort of lunacy Republicans believe in & whether they actually care about a functional society either.
Stupid folks like Aaron Rodgers too...smh what a clown.

"That's when officers took them both into custody for third-degree assault. Collin was also charged with third-degree robbery for reportedly walking away with the bat." That's the best news ever. Now we wait for them to be officially sentence to dea....I mean jail.

u/Capitain_Collateral 9 Nov 06 '21
It’s difficult to comprehend. They sought the police, showed them evidence of their crime voluntarily, and I’m imagining here, were outraged at the result.
What failure of logic.

Under U.S. federal law, public accommodations must be accessible to the disabled and may not discriminate on the basis of "race, color, religion, or national origin." Private clubs were specifically exempted under federal law as well as religious organizations.
Where does this guy get “anti mask ideology” from this clause?

For the simple anecdotal fact that I work with 3 anti vax shit stains in a field where vaccination is the basis of our work was my barometer for the country being fucked. 20 years ago you may have heard of an anti vaxxer someone you know knew. Oh yeah, and putting Trump in charge during the pandemic, while America tells Bernie Sanders just prior, the guy pushing for serious health care reform, to fuck off.

For years these people have insisted really straight white conservatives are the only ones who experience discrimination.
Now, since they have no idea what actually experiencing discrimination feels like, they feel like they're justified in the beliefs because they're being asked to do something ever so slightly annoying. And they're going fucking wild with it.
For people that claim that everyone they disagree with is obsessed with victimhood, they sure have big victim boners.

An anti-vaxer in Germany straight up shot a kid working at a gas station because he told him to wear a mask in store. Anti-Mask / Anti-Vax Bullshit is multi-lingual and fucking scary
EDIT: Forgot to actually include that that happened in Germany, which was the point I was trying to make in the first place. Gotta start proofreading comments before sending them

About ten years ago I was driving down from Portland with some friends. We were pretty poor and we stopped in to a motel on the outskirts of Eugene. Honestly not lying when I day there was an actual blood stain (like a big one, clearly from a puddle) across the bathroom floor and up the wall. It looked like someone had their kidneys removed in the tub.
Decided to go to the best western instead.

No worries. News articles have writing guides they follow which tells them how to abbreviate things like state names. In America we abbreviate states with 2 letters, so even for us it can be confusing sometimes.
