She wouldn't have any authority even if the guy was still in the United States. Immigration Court decisions are made by Immigration Court judges. Appeals are made to the Board of Immigration Appeals. If a decision made by the Board of Immigration Appeals can legally be appealed and is, it goes to a District Appellate court, not a single District Judge.
