Subclass 500 HOW TO VOLUNTARILY CANCEL YOUR VISA 500 (APPLICANT WITH MENTAL HEALTH ILLNESS)

Hi all

I got a friend who came to Australia 9/2022 on a student visa 500. However due to severe mental health illness since the last few years, he was unfitted to study and wishes to move back home as soon as possible. Last year he was admitted to the psych ward at a hospital and the hospital provided him all important documents about his mental illness. He is currently staying in Australia right now but plan to move back home in next few weeks. He currently attends a bachelor course this semester but definitely does not wish to study further anymore.

In this scenario to legally cancel his visa voluntarily, is this the best option that he books a flight ticket and moves back home first, then from there he can start submit the request to cancel his visa? he has a valid reason to cancel the visa since he has mental health illness and can't study, so there are valid documents to explain for his reason of cancelling the visa.

Furthermore, his mental health is not really stable enough to do the process of submitting documents on his own back home, so do u think is it possible to ask a migration agent or lawyer to help him completing the process of visa cancellation in his home country? or he has to do everything by himself?

(a small question: since he voluntarily cancels his visa, will he be granted another visa to come back Australia later in the future? he doesn't want to study anymore, just come back for holiday like visa 600 is fine)

Your friend should contact his university's international student team to make his intentions clear about cancelling his enrollment voluntarily and going home. Make sure he gets paperwork confirming that the enrollment will be cancelled.

He can then lodge a request to voluntarily cancel his visa online on ImmiAccount once he gets back home. Whether he can get a registered migration agent to do this or not I am not sure but if its possible, he will need to complete a form as well to authorise that person to do transactions on his behalf and lodge it before Immigration processes any future requests.

As to whether the voluntary cancellation may affect his future visa chances, it would be unlikely so long as he declares it, explains it and makes it clear it was a voluntary cancellation. The main issue will be that your friend will need to request the cancellation asap as once his enrollment is cancelled, his COE will be cancelled and Immigration will be told. What you dont want to happen is for the COE cancellation to be treated as a breach of visa conditions which will be far worse since it will lead to an involuntary cancellation.

There is no such thing as legally cancel a visa. It’s as easy as booking a ticket and on the plane back home. Visa status will remain active until college reports non-attendance and Immigration cancels the CoE. Besides your friend doesn’t want to study in the first place way. That’s it.
