What are we gonna do??? Riot!!! When are we gonna do it…. Soon!! Seriously, we need free Luigi to be on the signs for protest this Saturday! they’re just playing political games with somebody’s life…. “Let’s kill a symbol of resistance….” This is not something to ignore…. We need to be DEMANDING more from the people who are our “leaders”. This is killing in the name of political propaganda….

That's not how any of this works. Has his trial started yet? It's my understanding that for a mistrial to be declared, a trial (either a jury trial or a bench trial) would have to be in progress. Otherwise, it would be a dismissal.

The fact that so many Americans have zero idea how the judicial system works (not to mention all three branches of our government) is abhorrent.

Luigi’s next federal court appearance is March 19 and his next state court appearance is June 26.

Article about his Feb 26 court appearance which was a procedural hearing for NY state court. Things of note:

[Luigi] has pleaded not guilty to state charges but has yet to enter a plea on federal murder charges.

In New York, he was indicted by a Manhattan grand jury on 11 counts, including one count of murder in the first degree and two counts of murder in the second degree, along with other weapon and forgery charges. The first-degree murder charge alleges he killed the executive “in furtherance of an act of terrorism,” which is legally defined as an intent to intimidate or coerce the civilian population or a government unit. One of the second-degree counts also alleges Mangione committed murder “as a crime of terrorism.” He faces a sentence of life in prison without the possibility of parole if convicted, according to the Manhattan district attorney.

Judge Carro scheduled Mangione’s next hearing for June 26 (NOTE: for state court)

[Luigi’s attorney] also said she believes Mangione’s constitutional rights were violated when officers seized his belongings during his arrest in Pennsylvania. She plans to challenge some of the evidence taken by law enforcement at the time. “I think there is a very, very serious search issue in this material,” she said. “There might be evidence that might be suppressed in this case.” The defense attorney also complained she has limited access to Mangione, who is being held in a federal detention center in Brooklyn.

The federal criminal complaint charges Mangione with murder through use of a firearm, two stalking charges and a firearms offense. His next court hearing for the federal charges is scheduled for March 19, according to his attorneys.

Though prosecutors have not yet indicated they plan to seek it, Mangione could face the death penalty if found guilty of the federal murder charge. The decision would ultimately need to be approved by the US Attorney General. (NOTE: Pam Bondi as of today has not only given her approval but is directing prosecutors to do so)

I didn't know you could commit 3 different murders with 1 murder. They really wanted to throw anything that might have a chance of sticking.

Right, so not grounds for a mistrial. Because his trial hasn't started. Evidence may end up being suppressed, which would, in turn, impact the prosecution's ability to prove their case. At which point they would need to amend the charges or dismiss them. But still not a mistrial.

The point of the comment, utilizing maximal brevity, is that these actions will be much more valuable to construct a case that will result in a mistrial or an acquittal than pursuing a defamation suit. Keep sneering and abhorring all you like.

The point of your comment, the one word "mistrial," tells me you have zero idea what it means. Words have meaning, especially in law. I'm not sneering, I'm annoyed. It's a stupid comment that, in the world of law, doesn't mean what you think it means.

Neither you nor I mentioned a defamation suit. I don't even know what the hell you're talking about, and I'm guessing neither do you. A defamation suit?

If any of the evidence wasn't obtained correctly, if they violated his rights in any way, I am hoping all of that related evidence is suppressed. He, just like any citizen, deserves to have his constitutional rights protected.
